I'm going to India and is planning to get my h1 visa stamped...
How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...
I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..
Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...
Can someone pls advise me on this?

1. I got laid off from company A last year. I was on H1B. Company A notified me about 1 month in advance so I had some time to find another job. I also had a valid EAD which I wasn't using at that time. They also did not cancel I-140.
2. I joined Company B using my EAD within the 30 day period, so I never went out of status. Also, I didn't file AC21
3. My GC application was approved in the first week of Aug.
I have a couple of really interesting opportunities that I would like to pursue. My job profile has been similar at both A and B and will likely be similar even in C should I join there. Am I required to work at B for any specific period of time before I can pursue these opportunities?

Generally, the USCIS issues three copies I797A, I797B and I797C. Of these I797A is the Original approval sent to the petitioner while B and C are ourtesy copies sent that can be distributed by the petitioner to the beneficiary for his/her records and to the attorney for their records, etc... tyically, the USCIS and the Consulates require the form I797A for further processing the next stages.

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.

I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.

Once you file it usually take 1-2 months.But you have premium processing for I140 now,you can have result in two weeks.So don't worry ..just talk to your attorney.

My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??

I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.

What is Image Croping? U need to understand that! The area which you will select will give you the x y co-ordinates which should be fed into the LockBit method this method will retutn a pointer. Yes the code will be unsafe but it will work i did it. Now Use the scan0 property then increment the pointer [0] for green [1] for blue [2] red and copy to any another file which will become your new croped image. I can provide you the source code snippet but why dont u try for urself first thats how people lear not by spoon feeding. Try a bit googling with search string as Simple Dialation Using C#. My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

Hi all,
I need an urgent advice. on April 4th I started a new job in a good size company (200+ employers). 2 week before starting the job, I had sent the company all the information required to transfer the visa (paystubs, etc etc) and they confirmed that everything was fine.
Last week (Apr 27th) I have been asked by the Payroll company to provide copy of the I-797 to attach to the I-9. I contacted the company's immigration lawyer and he stated that they filed the transfer on Apr, 26th (3 weeks after i started working for them) and he should have the receipt shortly. This caught me off guard because I was sure they already filed the application before I started working for them. I am really concerned now as I believe I am out of status (or I have been for 3 weeks).
Should I be worried? what's your take on this?
Any help would be greatly appreciated.

I heard this ACT is voting on March 2 by senete members, (PHD students directly change to GC), even it pass tomorrow, how long it will become a law?Whether it needs to be passed by congress next?Is it possible to become a law before June?
