We filed a H4 to H1 Change of Status petition for my wife. The file was opened and processed by USCIS and a RFE was issued. Due to some family situation, we had to withdraw the H1 petition instead of replying to the RFE.

My question is: Is the security/anti-fraud fee ($1500) returned by USCIS in such cases. We applied through a big consulting company.

Can you buy a home while your 485 is pending? How about loan approval i.e., does it impact your ability to get loan?

I have my I 140 and I 485 (Aug 07 filer) for a future employment from a small company with EB2 as software engineer. I 140 still pending and got an RFE. I got the EAD. In a month am going to finish 180 days.


Currently, I work for Fortune's Best software company as sr. software QA engineer. My company wants to go ahead filing for my GC.

As this current company being a best american software company and I can stay for any longer, I wish to go ahead with filing for a fresh GC. However, I was wondering how I could use the benefits of the priority date from the previous 485 filing mentioned above. my company attorney suggests that am eligible for EB3 where as my 485 already filed is under EB2.

What would be the implication if my current employers files for EB3 and my previous I 485 filing is under EB2. What are the options that are available for leveraging the benefits of my previous filing or using EAD?

What is the best course of action.

you do not have to apply for COS, if she wants she can get h4 stamped when she travels, but is moot anyways as she plans to use EAD anyways nullyfying her H4.

No issues, since her H1B is independent of your I-485. As long as she was in her old job/the job mentioned on her G-325 on the day you filed your app. you should be okay.

I used to fedex EAD and AP applications etc to this Augustine Road address before. After introducing lock boxes, they changes the fedex address too.I am planning to submit AC21. Hello,

I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.

I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

We used to be in immi.com and murthy.com venting out how broken the immi process is and IV rose to provide direction and the lobbying effort admists incessant anti immigration forces.A new effort that take Guts to do ..that too being voulnteers!

Being a IV core member is a tiresome, thankless job...but still they continue to plough thro rocks..with meager funds and bunch of negative members..

Feb 15 will come and Go....we still need to work on getting our provisions into CIR...whether it passes or not this year..we still need our provisions to get into it..one cannot miss the window of oppurtunity...

Work will continue...be it Feb 15 or Aug 15..
