    My EB3 PD is Oct 2003. I-140 approved and I-485 ND is July24th.when can i expect to get the green card?. thanks in advance.

    I think all our folks here and myself have the same question too. My PD is 10/2003 and RD July 2nd. p_kumar, I can assure nobody can answer this question, not even USCIS. I am sure this site would have not existed if there was an answer. Sorry for beating round the bush, I am sure you would have known the answer by now.

    I know many people have their priority dates current since past few months but still they are waiting for I-485 approval. Hope this should not be scam to issue the EAD for only a year instead of two years.

    Almost two years jump is unbelievable specially we know big numbers of Perms filed during 2005 and mid of 2006.

    I think you bring up very valid points. For a lot of ppl who have stayed away from family/extended family for so long, they may not like the constant interference.

    "I miss my parents" is not quantifiable but what about the paying back the debt by supporting your aging parents? Let me make the question a little broader, isn't every immigrant divided between doing what's best for the children and supporting the parents?
    yes they are indeed. I took care of this as my sisters and parents have immigrated to New Zealand, work and live happily there and will be covered by a great social security system.

    also, they do not need a visa to visit me after they get their citizenship (in the next year or so) and I will not need one to visit them after I get mine in the next decade or so.......... :-))

    as for what is best, we should all ask our parents and they would say do whats best for your kid because that is what they did. they did their best for us and we should do the best for our kids as they should do their best for theirs........

    07/06/2007: Revised July 2007 Visa Bulletin

    The State Department has just released new July 2007 Visa Bulletin rather than "Update." It appears that this is intended to make it official July 2007 Visa Bulletin rather than previous release which was "update" in anticipation of the ALF class action lawsuit. One of the claims which have been addressed by various sources, INCLUDING THIS WEBSITE, was whether "update" can be considered a revised Visa Bulletin for the purpose of the regulations of DOS and USCIS. If it is not, the USCIS would have no authority to reject the I-485 applications in July.
    There is still confusion as to which one is considered July Visa Bulletin which is provided in the DOS and USCIS regulations as they have released three versions: (1) Visa Bulletin released in June; (2) Update of July Visa Bulletin; and (3) July Visa Bulletin which has just been released today. This can affect the definition of "class" of the class action and latter two releases can fall under the two different classes. I wonder why the DOS is adding further confusion to the nation which is already in a state of extreme confusion and in despair because of their previous action.

    Ok then, why did you come to America to study at Duke? Why did you spend all this money? The reason our people invest crores of rupees in American education is that it is better.

    You people seem to be too nationalistic. Even with the comments about quotas. Affiirmative action with 52% of all seats being reserved based on caste? You call this fair?
    I dont think anyone is arguing that american schools are not good enough.......they certainly are - specially with the kind of tuition fees people pay to get into these schools. Besides - people coming here for education does not necessarily mean its better - lot of people come here for the international exposure - lot of good students from around the world do indeed congregate here for education - combination of good schools, openness, english as common language....all these have contributed to the historical greatness of america - does not make your motherland any worse!

    Look at quotas as a way to bring in factors other than just your score in a standardized examination.......in India that factor might be caste - here it might be affirmative action in favor of some sections of society and other subjective factors like essays, letters recommendation, the fact that you were a cheerleader in high school etc.....look, i am not saying quotas is a great system - but all i am saying is that there are shortcomings in selection systems in schools around the world not just India.

    We are in the same situation. Big Company. They dont really care about how much our application is delayed

    Employer would not sign form 7001. Instead,can we complete the form 7001 for I-485 delay. the reason behind this is probably I-140 pending. Our priority date has been current for months. EB2 Dec 2003. InfoPass IO says that NC, BC are cleared. Do you think that this will help?

    One more thing. InfoPass IO told that our application has been transferred from TSC to NSC, then back to TSC and again transferred to NSC in March 2008. But online status has no LUDs since we gave FP in Jan 2008. Online status shows that our application is pending at TSC . This is confusing and i dont know where the application is. Can we also enquire about this situation using form 7001?

    What can we do about it ? I knew 3-4 guys who ported from EB3 to EB2 and even got their 485 approved because of this, during August.

    They most of the approvals are of US Master degree and above as it is straight fwd EB2 no need to verify skill set etc..

    While I can't speak for all cases out there, I can speak for myself and a few of my friends...Master's degree from US universities - CHECK, green card - NOT YET! (the wait continues).

    USCIS should come up with strategy like if you are in US for 'X' years and if your 485 pending for 'Y' years and if you own a house worth 'XXX$' , then they should give GCs irrespective of Category(Eb1,Eb2,Eb3,Eb4 etc..)
    People who can buy houses are more important to USCIS/US than people who already have bought houses.

    Bad news unless they allow mass conversion of TR applications into non-RIR. Imagine they took two years to get rid of 220,000 easier applications (2005 and 2006). Now they are left with some of the old TR applications and they must be thinking of how to meet the September deadline. I would not be surprised if they ask for an extension, citing processing difficulties.

    When you get the letter ready we'll send it again. It doesn't hurt to send them the letters 100 times.
    I believe in 1 thing.... Is the media(in this case letter) imparting the message ? If the answer is 'Yes', we are done!!!!
    Trust me my friend, spellings commas and fullstops doesn't matter...If you need to send out a message send it ASAP...
    mirage, I am not trying to turn down this effort. In Fact, I have sent at least 50 letters as part of IV campaigns and I have written so many on my own. All I was saying that we need a professional letter that will have better impact. Once we have the letter ready, I will be the first one to send it out.

    I think it is a good idea..Everyone should write to local Congressman/Women senator detailing the case and asking Why it is taking so much time to process the AOS.
    They will come back with standard answer like country quota etc..BUT
    This will create awareness among the lawmakers..


    I would say we should start with local congressional office. Every case whether it is resolved or not should be taken to the attention of local congressional office.
    If members volunteer to do this, we could distribute districts among ourselves and take care of each district's congressional office. In that way we could raise the awareness among the lawmakers. I do agree that not every office will be friendly to immigrants like my district's congressional office, but we have to try.
