The H1B visa (http://www.h1b.biz/lawyer-attorney-1137085.html) program is unlikely to reach its cap of 65,000 before the start of the 2010 fiscal with nearly 20,000 vacancies amid the economic downturn. This has happened for the first time in several years that the demand for the visas, which is mostly availed by Indian professionals, has slowed down.
Also due to a large number of rejections of H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) petitions, this figure of 20,000 vacancies has remained almost the same for the past two months. Past figures indicate that Indian IT professionals have been a major beneficiary of H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) visas. An additional 20,000 H1B can also be issued to those foreign professionals, who have masters or higher degree from the U.S. Though the U.S. Citizenship and Immigration Services (USCIS) received 20,000 petitions, it continues to accept applications in this category.

Yes in Montreal, Canada on Aug 26th, 2009. All is well. I got my h1b visa renewed for 3 years. They had to do electronic followup since my LIN is not found in PIMS. But I got my passport, visa next day at 3pm.

I have a question on visitor visa, please tell me is this legally okay or not
My parents got vistor visa (B1/B2) and planning to visit me,
my sister also got a visitor visa (B1/B2) through a company some time back. But she never visited US and later moved to another company.
All are 10 years multiple entry visas.
Is it okay that sister comes along with my parents? Is there a difference between company applied visitor visa and visitor visa that I sponsered.

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

I m not sure but I think he has to wait till he gets his citizenship . The other way to apply for Tourist or student visa. Tourist visa will be for short time and student visa will be hard to get if the Husband is Green Card holder.

Can some one reply to my post please. My question is regarding EAD only. Once I apply for EAD and go to India what happens
1. If I am not there while it approved? Can my frnd send me the EAD to India?
2. if I get called for finger printing for EAD and if dont go for it? Will my AOS will be treated as abandoned?

Hi
My wife is on h1.Her staffing company did not have a project from july 1st.
I applied for her h4 cos on july 7th.
Her company had applied for h1 amendment for change of location in may.status shows pending.
My question- are we safe in applying for h4cos on the basis of old approved h1.does the outcome of amendment h1 even matter, since there is no project anyhow and the person has applied for h4.

I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

Well this came out of nowhere. Last night the Senate passed an emergency border enforcement bill that provides $600 million for increased security on the southern US border. The $600 million will come from raising fees on staffing companies. The fee will increase by $2250 for each L-1 visa application for companies that employ 50 or more workers if 50% of the workforce is on an H-1B or an L-1. I just got an RFE on my 485 as following.
Submit a letter of employment attesting to your current employment. This letter should be written on the company's official letterhead and cite the date you started working, whether the position is permanent and full-time, a description of the position, a description of the position that you currently hold for the company (if any), and the offered salary.
When I invoked my AC21, my new lawyer submitted G-28 but with out any details about my new employment. I hoping that this RFE is related to that. My only concern is that my old job title is programmer analyst and my new job title is Business Solutions Architect with similar (probably a little more) job duties.
Please share your experiences if any one has received similar RFEs.

I came to US with H1 on Apr 2009. My wife who was working in the same company as I do, joined me on Dec 2009 with H4 visa. My H1 has expired on June 18 '10. I have applied for H1 extension much before and currently my status is pending with USCIS. Along with my H1 extension I have also applied for my wife's H4 extension. Her status is also pending.
My company has actually filed H1 visa for my wife for 2011 H1B quota.
I have the following questions, can someone kindly answer the same.
i) If my wife gets her H1 petition approved, should she travel back to my country to get it stamped and for her to work here in US?
Some say she should go back and some say she can start working here with her I797 notice, she can get it stamped whenever she goes to my country. Which is true?
ii) Assuming I get approval for my H1 extension and her H4 extension, should she get H4 extension stamped as well?
iii) Can she go for stamping for H1 as well as H4 in my country, if so which one should she go for first?
