Can someone confirm if 1 year of OPT training also counts towards work experience? My friend needs to know since he needs to apply for Labor Certification and wanted to find out if this experience can be counted apart from the H1-B working experience.

Dear Sir/Madam,
I would really appreciate if you can help on the question below.
1) My wife changed her last name after our wedding.
2) She got it updated on new passport, I-20 and SSN.
Now, we are planning to travel to India. She has her old as well as new passport .. and the F1 visa and I-94 is still at the old passport.
My question is: Does she need to get her F1 stamped again in order to get the updated name on her new passport?
I would greatly appreciate your fast response.

I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.

Hello everyone,
I have heard that if you cancel your first LC and apply for a Second one you can still use the advertisements and all from the first one if you fall withing that "6 month" period. My question is -
Is it 6 month from the first day that the advertisement was published or is it 6 month from the day your first LC was approved? :confused:
Experts please shed some light on this.

I think most Immigration Judges try to do their job in a fair way. But there are a few that really cross the line way too often. The press has covered this and I've tried to bring some of these problems to light in this forum. Now EOIR wants people who have been victimized by poor conduct from an Immigration Judge to complain and they've established a complaint portal on their web site.

Immigration legislation in Congress ended on a sour note in 2010. The DREAM Act, after narrowly passing in the House of Representatives, failed to get the necessary 60 votes in the Senate required to overcome a threatened GOP filibuster. You could ask your company to specify during the amendment that your work requires you to work in different cities as required for the purpose of the job. I know my H-1B amendment was sent in with this.

I have applied for I-140 in Oct 2006 and hvn't recd I-140 yet (Nebraska)
My 485/EAD checks got encashed today. My questions is do I need I-140 before FP or EAD card.

I sent my I-140 on Apr 16, premium processing. How long does the premium processing take? I have to leave for India in a weeks time, and wanted to know if I would receive it in time.

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.

I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

Hi,
Need some help here for my friend.
He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.
So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.
