My friend Angelo Paparelli writes about something that is probably on the minds of many immigration lawyers who've been practicing for more than a few years - will Congress and the President treat Iranian students in the US the same as we did for Chinese students 20 years ago when young people in that country rose up against an oppressive government? Harken back to the fallout from the Chinese Communists' quelling of democracy with tanks and bloodshed in Tieneman Square. The Congress and the first President Bush took two-and-a-half years to protect the Chinese citizens who feared return to the...

    I would appreciate some feedback on following situation;

    1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?

    2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?

    3) Would changing to H1B abondon her AOS?

    4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.

    4) If she can get H1B, can she still use AP for travel?

    6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.

    Thanks,

    Hello,

It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname

I have a Tourist Visa also stamped wich is OK. Also the data on my passport.

My I797 is OK and everything else is OK.

I am still in my home country. Should I be worried about it? Should I try change it here or in the US?

In any event, what's the correct procedure to change it?

    Thanks in advance

Last time (in 2008) TSC was very fast in approving the cases, NSC was bit slow, thought it would be a good statistic at a glance on approvals.
What is the purpose of knowing which center processed?

Congress Has Been Stymied By Bush, Republicans (http://www.nytimes.com/reuters/news/news-usa-congress.html) By REUTERS, December 11, 2007

WASHINGTON (Reuters) - President George W. Bush wants it known the U.S. Congress has been asleep at the switch since Democrats took over in January. The only problem is that he and his fellow Republicans have flipped off the switch at nearly every turn, Democrats say.

"The end of 2007 is approaching fast and the new Congress has little to show for it," Bush told reporters in the White House Rose Garden last week.

Rep. John Boehner of Ohio, the Republican leader in the House of Representatives, was even less generous. "Nothing has been accomplished all year," he said.

As they excoriate political opponents, Bush and his fellow Republicans in Congress have successfully stopped most major Democratic initiatives this year.

They have staged an unprecedented number of "filibusters" in the Senate, where Democrats do not have a big enough majority to end debate. The few times that wasn't the case, Bush used his veto pen to kill Democrats' top priorities, like ending the Iraq war, expanding health care to children from low-income families and expanding stem cell research.

"Sadly, Republicans in Washington are determined to make this a 'no-can-do' Congress," Assistant Senate Majority Leader Richard Durbin, an Illinois Democrat, said in his party's weekly radio address on Saturday.

With only a week or two remaining in the first half of 110th Congress that convened in January, there's a deflated feeling on Capitol Hill.

Democrats and Republicans complain not enough has been accomplished. The public seems to agree, with just one in five Americans approving of the job Congress is doing, even worse than the unpopular Bush's ratings.

The legislative deadlock might get even worse next year, as election campaigns for Congress and the presidency get into full swing.

Ethan Siegal of the Washington Exchange, a private group that tracks Congress, said of Republicans' opposition tactics: "The template for trying to get into power is to make sure the party in charge doesn't have many legislative successes."

But even many Republicans think accusations of a "do-nothing" Democratic Congress won't be enough for their party to win back their majority status in the November 2008 elections.

    PROMISES KEPT?

Democrats quickly fulfilled many of their 2006 campaign promises, raising the minimum wage for the first time in a decade, implementing stalled recommendations of the commission that investigated the September 11 attacks and trying to stop ethics abuses that plagued Congress during years of Republican leadership.

    Republicans blocked many other measures.

A top domestic priority -- reforming U.S. immigration law -- was buried by conservative Republicans in the House. On foreign affairs, Republicans killed repeated moves to bring combat in Iraq to an end, despite Americans' disenchantment with a war now in its fifth year. Anti-war feeling was a driving factor behind the Democrats' success in last year's elections.

Popular legislation to expand stem cell research to help cure diseases such as Parkinson's was vetoed by Bush, as was a bill to deliver health care to more children from low-income families.

More recently, the House passed an energy bill that would improve automobile fuel efficiency for the first time in 32 years but Senate Republicans, heeding a White House veto threat, stopped it.

And Bush has veto threats on the remaining bills to fund the government through next September.

He recently told Arkansas business leaders: "You're fixing to see what they call a fiscal showdown in Washington."

But despite the bluster, Bush and congressional Democrats are at odds over a relatively tiny slice, about $11 billion, of the nearly $3 trillion budget.

Negotiations between the two finally have begun, but a compromise -- some war funding coupled with some of the additional domestic spending Democrats want -- was showing signs of souring this week, again amid accusations of Republican sabotage. There's plenty of incentive for a deal though as neither side wants government shutdowns to begin if agencies run out of money this month.

    Hi,

I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?

This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

    Thanks.

My question is how many affidavit of supports one can sign for different people? What are my liabilities if his brother later do some thing wrong in USA?

A Federal Judge has certified a nationwide class in a challenge to the USCIS's restrictive interpretation of the "automatic conversion" clause in the Child Status Protection Act (CSPA) of 2002. This opens the way for children who have "aged-out" to be reunited with their parents. The USCIS has resisted implementing this important section of law for the past seven years. Just a few weeks ago, the Board of Immigration Appeals (BIA), in Matter of Wang, adopted the government's restrictive interpretation of the automatic conversion clause. On July 16, Federal Judge James Selna (Central District, California), over government objections, made his...

Thanks to Richard Reid, we all have the extra task of removing our shoes when we go through security at airports. The "shoe bomber" from England tried to set off a bomb hidden in his shoes ten years ago, but thanks in part to Canadian born, Trinidad raised Kwame James, Reid was unable to carry out his plan. James, at 6 foot 8 inches, was then a 22 year old basketball player. An astute flight attendant woke James up and got him to help subdue Reid. Both Reid and James were in the news this week, though for very different...

My company is filing 140 and 485 on a preapproved LC (PD of 2005)

But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.

    1)How Can I have 2 140's ?

    3)How will it effect 485?

    I'm confused ..please answer

This is very confusing. I already sent my I-485 along with a new filing fee of $1010 in total $930 for the application and $80 biometric fee last August 3rd. USCIS already received my application my question is are they going to reject my I-485 b/c they just revised that we have to pay the old filing fee for July Bulletin? I used The current I-485 form version dated 7/30/07 Y.

I'm so confused! Due to this, I'm just gonna send another application b/c the chances of them rejecting/returning it back to me is High. If they don't return it back this week then I won't be able to file my I-485 after August 17th. Is ok to send another application? Can I just attach an explanation? I would rather take this chance than not being able to file it again after Aug 17.

Can someone please tell me the old filing fee including the biometric fee??

I just couldn't find this on their website.... I'm so lost.. thanks for the help

    Hi
My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.

    Please clarify these doubts:
When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?

Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?

If the F2 application is pending, is it possible to reapply from F2 back to H1B during that period?

Any help will be greatly appreciated.
    Thanks,
    Ingam

I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

    China visa (http://www.myvisapassport.com/visa-China.htm)

    Thanks & Regards
