    Hello All,

    I am new to this forum and this is my first post. I am not sure if I can even bring this topic up about PERM in this forum. So, if this is irrelavant, please let me know.

    My employer will be submitting a PERM application for my L.C. in a day or two. All the requirements for the job are complete. My question is, on the applciation there is question (Q:12) which states about "business necessity" and my employe will be checking "NO" as the answer. I am not sure what impication this could have on my application. The job requirement is B.S. degree with 5 yrs experience. I have a M.S. degree with 5 Yrs experience.

    Please let me know if we are going in the right direction.

    Is there any way to know if 140 revoked after approval.is there any change in LUD ?

    Put the reciept # in the USCIS online case status, if you see a LUD, check the case status, you might be able to see the "new text/info"

    I am on H1 visa and I have a sister with citizenship.
    I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
    Is it OK to file 2 green cards applications? which one will take place then?

    I am planning to visit India soon. I have my AP and an expired F1 visa.
    I haven't been to India since I got my H1 approved; so I don't have an H1 visa stamp on my passport at all. My I-797 is approved until 2010.
    Can you please advise if I should get my passport stamped with my H1 or should I be ok with my AP?

    You can extend status while living at US, but for re-entry after international travel (after November 26, 2009) you must get the visa stamped on your passport.

    My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
    In addition, I am asking her to take utility bills and bank certificates and paystubs.
    As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????

    Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

    Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

    I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

    Please suggest.
