Dear Attorney,

I am a July 2007 I-485 filer. Have an EAD but primarily working on H1B full-time as a Systems Analyst. I am a Certified Fitness Trainer but not sure if I can use my EAD to work as a Fitness Trainer in a local Gym (part-time).

Hi,

Firstly, I would like to apologize for my ignorance & starting a new thread on this topic. I have some questions on porting & hopefully you learned people would help me on this.

1. When is the actual PD porting done? Is it done at I-140 stage?
2. I have I-485 filed in EB3-I. Now, I do my labor in EB2 & then at the time of applying I-140 do I tell USCIS that I have an old EB3 with PD of Nov 2004?
3. Say I do that, will USCIS automatically change my category on my pending I-485?
4. When I filed my I-485 in EB3, I was single. Now I am married. If USCIS automatically adjudicates my pending application, I believe, I will be in soup since my wife is not included in that. So should I (or the attorney) tell them NOT to adjust category on my pending I-485 instead I file a new I-485 under EB2?

Attorneys please advice on my case below....

I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.

Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.

My questions are:


Is it approved by error?



What are the risks involved for now and down the road.



Can we travel outside United States using this GC.


Will appreciate any advice.

Most people have now heard about Stephen Colbert's testimony in front of the House Immigration Subcommittee this week on the subject of new laws for migrant farmworkers. Hello Gurus,

I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.

My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.

Is it OK if I accept this position with double salary?

Currently my 485 is pending over 1.5 years with I-140 approval (2007). I was laid-off. I have valid EAD card. Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Disclaimer: I'm not an immigration attroney, so please check with one for your situations as laws/procedures are changing frequently.

I have a question on filling up this form

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?

There is a slot for I-94 admissions# which I have filled up.

Any help will be appreciated.

Can you use your spouse's cross-chargeability after you have filed for your I-140 already?

How time consuming is this for the USCIS to acknowledge?

Does spouse also need to have a GC application filed at that time or if your spouse is from a non-retrogressed country but not working then you can use her also?
